Terms of Service

1. Acceptance of Terms
By creating an account or using the Polishly service, you agree to these Terms of Service. If you do not agree, do not use the service. We may update these terms; continued use after notification constitutes acceptance of the revised terms.
2. Service Description
Polishly provides AI-powered photo enhancement for real estate, vehicle, and product images. The service operates on a credit basis: one credit produces one enhanced image. A limited free preview (with watermark) is available without an account. Enhanced images are stored for 48 hours after processing, after which they are permanently deleted. We do not guarantee availability of specific AI models or output quality, as AI-generated results may vary.
3. Credits and Payment
Credits are purchased as one-time payments with no subscription or expiry. Credits are non-refundable except in the following cases: if the service fails to process your image (a technical error on our side), your credit is automatically refunded to your account immediately. Refunds to your payment method are not provided. If you believe a credit was incorrectly deducted, contact support@polishly.com within 14 days. Upon account deletion, any remaining credit balance is forfeited. All prices are shown in EUR and are inclusive of applicable VAT.
4. User Obligations
You agree not to: upload images you do not own or have rights to enhance; upload images containing illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content that glorifies violence; use automated scripts, bots, or programs to interact with the service without prior written consent; attempt to circumvent rate limits, free tier restrictions, or other access controls; reverse-engineer, decompile, or attempt to extract the underlying AI models or prompts. use the quality feedback and refund mechanism fraudulently, including but not limited to: downloading enhanced photos and subsequently requesting refunds, systematically reporting satisfactory results to accumulate credits, or using automated tools to submit feedback. Polishly reserves the right to suspend accounts engaged in refund abuse and forfeit remaining credit balances. Abuse is determined by automated monitoring and manual review.
5. Intellectual Property
You retain full ownership of your original uploaded images and the AI-enhanced outputs. We claim no rights to your content. By using the service, you grant us a limited, temporary licence to process your images solely for the purpose of providing the enhancement service. This licence terminates when your images are deleted (within 48 hours of processing). The Polishly brand, interface, and software are our intellectual property and may not be copied or redistributed.
6. Limitation of Liability
To the maximum extent permitted by Italian law, Polishly is not liable for: indirect, incidental, or consequential damages arising from use of the service; loss of data beyond what is described in the 48-hour retention policy; AI-generated output quality not meeting your expectations. Our total liability for any claim is limited to the amount you paid for credits in the 30 days preceding the claim. Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.
7. Governing Law and Disputes
These terms are governed by the laws of Italy. For consumers resident in the EU, mandatory consumer protection laws of your country of residence also apply. Any dispute that cannot be resolved through direct contact with us (support@polishly.com) may be brought before the competent Italian courts. EU consumers may also consult the European Commission’s consumer redress and alternative dispute resolution resources available on the Consumer Redress in the EU website.
8. Changes and Termination
We reserve the right to modify or discontinue the service with reasonable notice where possible. We may suspend or terminate accounts that violate these terms. You may delete your account at any time from the account page. Upon termination, your data is handled as described in the Privacy Policy.
